1. GENERAL PROVISIONS AND DEFINITIONS

Site-ul www.alterart.ro denumit in continuare Alterart sau Site-ul este detinut de catre COMSA OANA PERSOANA FIZICA AUTORIZATA, persoana fizica autorizata romana, cu sediul in judetul Mures, Isla, Strada Isla Nr. 7, inregistrata la Registrul Comertului sub nr. F2024011222006 , avand CUI 50672857, societatea avand drept exclusiv de proprietate intelectuala asupra continutului Site-ului, fiind denumita in continuare the owner of the Website/Seller/Professional.
Through the Alterart website, COMSA OANA PERSOANA FIZICA AUTORIZATA, as a seller, ensures the sale of goods and/or services exclusively to natural and legal person clients who access the Website as buyers. The following terms will be defined as follows:
User - any natural person who accesses the Website in order to consult the commercial offer of the Website owner, regardless of whether or not they place an Order for the purchase of products/services; 
Client – orice persoana fizica ce acceseaza Site-ul si plaseaza o Comanda in vederea cumpararii de produse/servicii in nume propriu sau ca reprezentant al unei persoane juridice;
Buyer – Clientul (persoana fizica sau juridica) care a incheiat un Contract cu detinatorul Site-ului conform definitiei date contractului in cele ce urmeaza; Clientul persoana fizica este denumit in cele ce urmeaza si Consumator;
Account - the section of the Website consisting of an e-mail address and a password that allows the Buyer to submit the Order and that contains information about the Customer/Buyer;
Produse, bunuri si servicii - any product, good or service to be provided by the Seller to the Buyer as a result of the concluded Contract;
Order – solicitarea transmisa in format electronic prin care cumparatorul isi manifesta intentia de a achizitiona bunuri sau servicii prezentate in oferta magazinului online Alterart;
Contract – Order confirmed by phone (by confirmation phone call from the Seller to the Buyer) or electronically (by sending a confirmation email/electronic message from the Seller to the Buyer).
Content – all the information published on the Site that can be viewed/accessed using an electronic device.
The general terms and conditions provided below will apply to all sales of goods and services by COMSA OANA PERSOANA FIZICA AUTORIZATA on the website www.alterart.ro.

2. USER REGISTRATION

In order to place an Order for products/services offered by Alterart, the User will register on the Site as a potential Client. In this sense, you commit and guarantee that you provide real, accurate and complete data, as requested by the registration form.
The Site Owner reserves the right (but not the obligation) to verify the authenticity of the Users' registration data regarding their existence. 
Prin acceptarea termenilor si conditiilor, The user expresses his consent for the possible checks that will be carried out by the administrators of the Site as a safety measure for the reality and accuracy of the data provided.
If it is found that the information provided by the User is inaccurate or inconsistent with that provided by the legal authorities, the owner of the Site reserves the right to suspend or terminate the User's access to the Site's services and to refuse current or future attempts to order products/services offered on the Site. 
By accessing the Site and the services made available, the user guarantees that he provides the owner of the Site with correct data, being solely responsible for the information provided.

3. REGISTRATION AND CONFIRMATION OF THE ORDER

The products offered by the Alterart online store can only be sold based on an Order. The order will be processed according to the provisions below.

By placing an Order through the Alterart online store, the buyer agrees to the form of communication through which the seller conducts its operations (electronically).
An order placed on the Website includes:
- the goods/services found in the offer of the Alterart online store;
- clear mentions regarding the invoicing and delivery dates as well as other special mentions;
- the Buyer's specifications.

Placing an Order does not imply confirmation of the Order and the Contract.

The steps for completing an Order and concluding the Contract are the following:
a. Order registration by generating a unique code for each registered Order;
b. the taking over of the Order by a sales agent, within working hours, from Monday to Friday between 9am and 5pm; 
c. the confirmation of the Order is carried out only after checking the Order and the stock, as well as the volume of work in progress. This confirmation is made exclusively by a sales agent, by telephone or electronically (e-mail);
d. the delivery of the Order is carried out only after the confirmation of the Order and after the establishment of the delivery details by the sales/delivery agent and by the Buyer.

The Seller can cancel the Order made by the Buyer, following a prior notification addressed to the Buyer, without any subsequent obligation of either party to the other or without any party being able to claim damages to the other in the following cases:
a. non-acceptance by the issuing bank of the Buyer's card, of the transaction, in the case of online payment;
b. invalidation of the transaction by the card processor in the case of online payments;
c. the data provided by the Client/Buyer in the form on the Website are incomplete and/or incorrect;
If a product and/or service ordered by the Buyer cannot be delivered by the Seller for any reason, he will inform the Buyer and return the value of the product and/or service to him, within a maximum of 7 (seven) days from on the date on which the Seller became aware of this fact or on the date on which the Buyer expressly expressed his intention to terminate the Contract.

1. PRICE AND STOCK OF PRODUCTS

Prices and product stock are updated by the online store as information is received from suppliers. The prices in the Orders are valid until the date of change of the purchase prices communicated by the suppliers.
If the prices or other details related to the products were displayed incorrectly, including due to the fact that they were entered incorrectly in the database, the Buyer acknowledges the Seller's right to cancel the Orders (requests for products that have not been confirmed) that contain these products and to notify customers as soon as possible about the error that occurred.

1. DELIVERY OF PRODUCTS

Products are delivered by fast courier, anywhere in the country.
The delivery terms will be communicated by phone or e-mail after confirming the order for the products in the seller's stock. There may be delays in delivery caused by the exhaustion of stock at suppliers, the workload, internal technical problems or external factors. 
Dupa receptionarea Comenzii se recomanda verificarea produselor pentru a nu prezenta defectiuni fizice sau neconformitati in raport de specificatiile comenzii.

1. BILLING AND PAYMENT

Pretul, modalitatea de plata si termenul de plata sunt specificate in fiecare Comanda. Vanzatorul va emite catre Cumparator o factura pentru bunurile si/sau serviciile livrate, Cumparatorul obligandu-se sa furnizeze toate informatiile necesare emiterii facturii conform legislatiei in vigoare.
The Seller will send the Buyer the invoice related to the Order in electronic format, to the e-mail address mentioned by the Buyer in his account created on the Site.

1. PRODUCT WARRANTY

All products sold by the Alterart online store benefit from warranty conditions according to the legislation in force and the commercial conditions of the manufacturers and distributors. 
The warranty conditions are in accordance with the provisions of Law 449/2003 and O.G 21/1992 with subsequent amendments. According to Law 449/2003 "in case of non-compliance, the consumer has the right to ask the seller first of all to repair the product or has the right to request the replacement of the product, in each case without payment, except for the situation where the measure is impossible or disproportionate". 
Repararea/inlocuirea produselor va avea loc in termen de maxim 15 zile calendaristice. In acest sens, definitia Consumatorului este urmatoarea: „orice persoana fizica sau grup de persoane fizice constituite in asociatii, care, in cadrul contractelor care intra sub incidenta prezentei legi, actioneaza in scopuri din afara activitatii sale comerciale, industriale sau de productie, artizanale ori liberale”. Persoanele juridice nu intra sub celor doua legi mentionate anterior.

1. RETURN OF PRODUCTS

In ceea ce priveste comenzile clientilor persoane fizice se aplica prevederile O.U.G. nr. 34/2014 privind drepturile consumatorilor in cadrul contractelor incheiate cu profesionistii, precum si pentru modificarea si completarea unor acte normative.
Inainte de expirarea perioadei de retragere, Consumatorul are dreptul de a se retrage din prezentul Contract, fara a fi nevoit sa justifice decizia de retragere si fara a suporta alte costuri decat cele prevazute la art. 13 alin.(3) si art.14 din O.U.G nr. 34/2014, in termen de 14 zile incepand cu ziua in care intra in posesia fizica a produsului. Cheltuielile de returnare sunt suportate de consumator.
Produsul returnat trebuie sa fie in aceeasi stare in care a fost livrat (in ambalajul original, cu toate accesoriile, cu etichetele intacte si documentele care l-au insotit). Nu se accepta pentru returnare produsele care prezinta modificari fizice, lovituri, ciobiri, zgarieturi, socuri, urme de folosire excesiva si/sau interventii neautorizate etc.
The seller will refund the value of the product within a maximum of 14 (fourteen) days from the date of the consumer's notification of his decision to withdraw from the Contract. The seller will be able to postpone the reimbursement of the product's counter value until receiving the sold product or until receiving a proof according to which it has been shipped. According to art. 11 of GEO 34/2014, before the withdrawal period expires, the consumer informs the professional about his decision to withdraw from the Contract. In this sense, the consumer will send the seller his decision to withdraw from the Contract by means of an email sent to the address included in the contact section.
In conformitate cu prevederile art. 16 din O.U.G. nr. 34/2014, sunt exceptate de la dreptul de retragere produsele comandate si/sau confectionate dupa specificatiile prezentate de consumator sau personalizate in mod clar; produsele susceptibile a se deteriora sau a expira rapid; produsele care nu pot fi returnate din motive de protectie a sanatatii sau din motive de igiena; produsele care sunt, dupa livrare, potrivit naturii acestora, inseparabil amestecate cu alte elemente.

1. CHANGES TO THE SERVICE

The owner of the Website reserves the right to modify or interrupt, temporarily or permanently, access to the Website (in whole or only in part). In this case, the owner of the Website is not liable to the User or to a third party for any modification, suspension or interruption of the services available through Alterart.

1. INTELLECTUAL PROPERTY

The user expressly declares that he is aware of the fact that all the graphic creation and the content of the Site are the property of Alterart. I make an exception for information and graphic elements registered by Users, as well as graphic signs belonging to other entities.
Utilizatorul accepta ca orice software folosit in legatura cu serviciile oferite de Site contin informatii confidentiale si aflate sub drept de proprietate, fiind protejate de legile privind dreptul de proprietate intelectuala, industriala si alte legi aplicabile. 
The user undertakes not to reproduce, copy, sell or exploit the services, information and/or audio-video materials to which he has access as a result of using this Site, in whole or in part.
The user is prohibited from modifying, renting, assigning, lending, selling, distributing or creating derivative materials based on the services or programs used within the Site.
The photos shown are informative and may contain accessories that are not included in the standard package of the product.
Specificatiile tehnice sunt informative, pot fi schimbate fara nevoia de instiintare prealabila si nu constituie obligativitate contractuala.

1. LIABILITY

Utilizatorul declara in mod expres ca accepta urmatoarele conditii: 
1. the use of the services made available/the placing of Orders on the Site is done at your own risk. The owner of Alterart is expressly absolved of any liability, including, but not limited to, indirect warranties of merchantability or compliance with specifications for a particular purpose. 
2. The owner of Alterart does not offer any guarantee that:
– the services meet all user requirements;
- the services will be uninterrupted, on time, safe or without errors;
– program errors will be corrected. 
3. The user who bases his decisions, actions or inaction on the information contained in this website assumes full responsibility for any losses incurred;

1. LIMITS OF LIABILITY

Utilizatorul accepta in mod expres ca detinatorul Site-ului nu va fi raspunzator pentru nici un fel de daune sau prejudicii directe, indirecte, accidentale, speciale, inclusiv, dar nu limitat la prejudicii prin pierdere de profit, posibilitatea de folosire, date sau alte pierderi intangibile sau incomensurabile (chiar daca detinatorul a fost anterior informat despre posibilitatea aparitiei unor asemenea pierderi), rezultand din:
– the use or impossibility of using Alterart services;
– unauthorized access to or damage to User transmissions or data;
- statements or actions of a third party on the Site's services;
- any other problem related to the Site's services.

1. NOTICES AND COMMUNICATIONS

Notifications/communications addressed to users will be made electronically, via e-mail. The owner of Alterart can make notifications regarding the change of the Terms of Use or other matters by displaying notices to users in general, on the Site.

1. MAJOR FORCE

The owner of the site is not obliged to comply with the obligations stipulated in the Terms of Use, as a result of a cause beyond the control or, including but not limited to fortuitous events, other actions/inactions for which the administrators of the Site are not responsible .

1. APPLICABLE LAW

By accessing this website, the User accepts that this Agreement and any dispute related to it are governed and interpreted in accordance with Romanian laws, and the User agrees to submit to the exclusive jurisdiction of the competent Romanian courts. 
Alterart does not guarantee that the content of this site is subject to the laws (including those of intellectual property) of other countries outside of Romania.

1. FINAL CLAUSES

The Terms of Use represent the agreement of the parties and regulate the User's use of Alterart services, replacing any previous agreement between the user and the owner of the Site. 
If, after the launch of the Website, additional services made available on the Website will be implemented, these services will be subject to the same rules and conditions contained in these clauses, if they will not benefit from conditions distinct from these.

By accessing and registering your data on this Site, you accept the terms and conditions above, they have the value of a contract, tacitly accepted, between the user and the owner of the Site. If you do not wish to be bound and to comply with the rules described above, please do not use the services provided by this Site.
